GAMEHOUSE ADVENT CALENDAR TERMS AND CONDITIONS

The following terms (“Terms”) are the terms and conditions that form a legal agreement between you ("You", “Yours”) and GameHouse Europe B.V., an affiliated company of RealNetworks, Inc. ("GameHouse") governing Your participation in the GameHouse Advent Calendar campaign (“Advent Calendar”) applicable to GameHouse's games (“Games” or “Game”).

These Terms include a mandatory arbitration clause to resolve disputes, and a class action waiver provision. Please, read them carefully.

By accessing, using and/or participating in the Advent Calendar, You expressly agree to comply and be bound by the legal documents listed below, which, collectively, are part integrant of the Terms.

• these Terms, which governs Your participation in the Advent Calendar;
• the     GameHouse        Privacy          Policy, located at https://www.gamehouse.com/privacypolicy, which governs GameHouse collection and use of Your personal and non-personal information;
• the GameHouse Terms of Service, located at https://www.gamehouse.com/terms-of-service, which governs Your use and/or access to the products and services offered by GameHouse; and
• the RealNetworks   Arbitration   and   Dispute   Resolution   Policy, located at https://realnetworks.com/arbitration-policy, which governs the way in which any claim or dispute between You and GameHouse is resolved.

ADVENT CALENDAR TERMS.

1. Eligibility. The Advent Calendar is open only to natural persons who have an account/guest account with GameHouse during and throughout the Participation Period. In order to assign the playtime to the right participant, the participant must be logged in when playing games to count towards the daily requirements of the event.
   
   
2. Participation Periods. The Advent Calendar participation will begin at 00:00 local time of the participant on 1^st of December, 2022 and ends at 23:59 local time of the participant on 12^th of December, 2022 (“Participation Period”).
   
   
3. Registration Process. The Advent Calendar registration is automatic to all users with a valid GameHouse account at the time that the Participation Period begins. If you do not wish to participate in the Advent Calendar, You can simply ignore the Reward. Registration is limited to one (1) entry per person. If you don’t have a GameHouse account, You can register to the Advent Calendar by creating a GameHouse account or guest account until the Participation Period starts.
   
   
4. The Advent Calendar Conditions. The Advent Calendar is fun and simple, and You need to cumulatively meet the below conditions:

• 30 MINUTES DAILY. You must play at least thirty (30) minutes per day. For the play time to be counted towards Your daily progress, the Games need to be opened, played and closed. ATTENTION, not closing the Games after playing will not be counted towards Your daily goal. If You continue to play the Game after 23:59 those minutes will not count towards the second day credits. Therefore, please close the Game and start a new session in the new day; and
  
  
• 2 DIFFERENT GENRES. You must play at least two (2) different genres of Games per DAY. We want to make it easy: if You play one genre in the previous day, You are allowed to repeat the same genre the next and every day of the Advent Calendar.

For the purposes of these Terms, a “day” is considered from 00:00 to 23:59 local time.

You can track Your progress (day, minutes, and genres) on the special event page in Your account.

5. The Reward.
   
   5.1. Each day during the Participation Period, EVERY PARTICIPANT THAT FULFILLS THE DAILY CONDITIONS OF THE ADVENT CALENDAR WILL RECEIVE ONE DOWNLOADABLE CUSTOM WALLPAPER (the "Reward").

   5.2. The Reward is personal to You and to Your account, and may not be transferred or assigned to another person or account. If You successfully fulfill the Advent Calendar and all its requirements, You will be able to claim Your prize on the Advent Calendar page that same day and within seven (7) days after the end of the Participation Period.
   
   

6. Explicit consent for public announcements. Participation in the Advent Calendar and/or acceptance of the Reward constitutes Your consent to, and grant of, a perpetual, worldwide, royalty-free to use Your name, address (city, state, country), likeness, or alike for advertising and marketing promotion without notice or additional compensation, except where prohibited by law. To opt-out from any public announcements, please contact customer support through Your account or write us an email at [e-mail].
   
   
7. Disclaimer. Rewards are awarded “as is, where is,” without warranty of any kind, express or implied, including without limitation any warranty of merchantability or suitability for a particular purpose.
   
   
8. Limitation of Liability. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAWS, YOU ACKNOWLEDGE AND AGREE THAT IN NO EVENT WILL GAMEHOUSE BE LIABLE OR OTHERWISE RESPONSIBLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL AND/OR PUNITIVE DAMAGES, FOR ANY REASON(S) OR FOR ANY CAUSE(S), REGARDLESS OF WHETHER GAMEHOUSE WAS/IS INFORMED OF THE POSSIBILITY THAT SUCH DAMAGES MAY EXIST.
   
   
9. Indemnification. You agree to hold harmless, indemnify and defend GameHouse, its officers, directors, agents and employees, from and against any claims, liabilities, losses, damages, judgements, awards, fines, penalties, fees and/or expenses (including attorneys' fees and costs) arising out of or relating to, either directly or indirectly, by Your violation of any of the Terms.
   
   
10. Termination. Without any liability to You, GameHouse reserves the right to refuse, restrict, prohibit, suspend or reject Your access to, use of, and/or participation in the Advent Calendar, at any time, if You are in breach or violation of these Terms. Immediately upon termination by breach, You forfeit all rights, title and interests in and/or to any Reward. Any attempt by You to undermine the legitimate operation of the Advent Calendar by cheating, deception or other unfair playing practices or intending to annoy, abuse, threaten or harass any other participants may also result in Your disqualification without notice in addition to any other available remedy, including, but not limited to, damages and attorney’s fees.
    
    
11. Notices and Support. Any questions regarding the Terms and all legal notices shall be sent to by email to [e-mail]. You can also contact customer support through Your account or via the online form.
    
    
12. Changes to the Terms. Game House reserves the right, in its sole discretion to cancel, modify or suspend the Advent Calendar in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the Advent Calendar is, in whole or in part, compromised. Game House furthermore reserves the right to substitute the Reward or amend the Terms at any time. Any such modifications will be published on https://www.gamehouse.com/.
    
    
13. General Provisions. You acknowledge and agree to comply with all applicable laws, codes, regulations, rules and/or requirements regarding Your access, use and/or participation in the Advent Calendar. These Terms and any rules, terms or policies referenced herein or incorporated herein are the complete agreement of the parties concerning the subject matter hereof and may not be amended or in any manner modified except at GameHouse sole discretion. If any provision of the Terms is found to be unenforceable, the remainder shall be enforced as fully as possible, and the unenforceable provision shall be deemed modified to the limited extent required to permit its enforcement in a manner most closely representing the intention of the parties as expressed herein. Failure to enforce any provision of the Terms will not constitute a waiver of any the terms and conditions. The English language version of the Terms controls and governs.
