The Crown Challenge - Terms and Conditions

GAMEHOUSE CROWN CHALLENGE TERMS AND CONDITIONS

The following terms (“Terms”) are the terms and conditions that form a legal agreement between you ("You", “Yours”) and GameHouse Original Stories B.V., an affiliated company of RealNetworks, Inc. ("GameHouse") governing Your registration and participation in the GameHouse player engagement campaign (“Crown Challenge”) applicable to GameHouse' games (“Games” or “Game”).

These Terms include a mandatory arbitration clause to resolve disputes, and a class action waiver provision. Please, read them carefully.

By registering for, accessing, using and/or participating in the Crown Challenge, You expressly agree to comply and be bound by the legal documents listed below, which, collectively, are part integrant of the Terms.

• these Terms, which governs Your registration and participation in the Crown Challenge;
• the GameHouse Privacy Policy, located at https://www.gamehouse.com/privacypolicy, which governs GameHouse collection and use of Your personal and non-personal information;
• the GameHouse Terms of Service, located at https://www.gamehouse.com/terms-of-service, which governs Your use and/or access to the products and services offered by GameHouse; and
• the RealNetworks Arbitration and Dispute Resolution Policy, located at https://realnetworks.com/arbitration-policy, which governs the way in which any claim or dispute between You and GameHouse is resolved.

CROWN CHALLENGE TERMS.

1. The Crown Challenge is open only to natural persons who have an account/guest account with GameHouse at the time of registration and throughout the Participation Period. You are not eligible to participate, and GameHouse reserves the right to disqualify You, if You are an employee of GameHouse or any of its affiliates, subsidiaries, and agencies, or a member of their immediate family or persons living in the same household. For purposes of this clause, immediate family members include children, parents, spouses and significant others (i.e. girlfriends/boyfriends, domestic partners and spousal equivalents).
2. Registration and Participation Periods. The Crown Challenge registration period will start at 00:00 local time of the participant on 25^th of July, 2022 and ends at 23:59 local time of the participant on 31^st of July, 2022 (“Registration Period”). The Crown Challenge participation will begin at 00:00 local time of the participant on 1^st of August, 2022 and ends at 23:59 local time of the participant on 29^th of August, 2022 (“Participation Period”).
3. Registration Process. Registration is limited to one (1) entry per person. During the Registration Period, You can register by (1) creating a GameHouse account/Guest account and opting to enter the Crown Challenge; or (2) if You already have an account, by logging in and clicking on the “Enroll” button. Please ensure You have received the confirmation email of Your registration and participation. If You do not receive a confirmation email, please try to enroll again or contact customer support through Your account or via the online form.
4. The Crown Challenge Conditions. The Crown Challenge is fun and simple, and You need to cumulatively meet the below conditions:

• 27 DAYS. You must play at least twenty-seven (27) days out of the twenty-eight (28) of the whole Participation Period; ATTENTION, if You continue to play the Game after 23:59 those minutes will not count towards the second day credits. Therefore, please close the Game and start a new session in the new day;
• 10 MINUTES DAILY. You must play at least ten (10) minutes per day. For the play time to be counted towards Your daily progress, the Games need to be opened, played and closed. ATTENTION, not closing the Games after playing will not be counted towards Your daily goal. If You continue to play the Game after 23:59 those minutes will not count towards the second day credits. Therefore, please close the Game and start a new session in the new day; and
• 4 DIFFERENT GENRES. You must play at least four (4) different genres of Games per week. We want to make it easy: if You play one genre in the previous week, You are allowed to repeat the same genre the next and every week of the Crown Challenge.

For the purposes of these Terms, a “day” is considered from 00:00 to 23:59 local time.

5. The Reward.
   • At the end of the Participation Period, EVERY PARTICIPANT that fulfills the conditions of the CROWN challenge will receive a free ONE MONTH SUBSCRIPTION TO THE GAMEHOUSE WEBSITE (the “Reward”).
   • The Reward is personal to You and to Your account, and may not be transferred or assigned to another person or account. If You successfully fulfill the Crown Challenge and all its requirements, and You will be able to claim Your prize on the Crown Challenge page within fourteen (14) days from the end of the Participation Period (the "Claiming Period"). If You do not claim Your Reward within the Claiming Period, GameHouse reserves the right not to apply the Reward to Your account. GameHouse may, at its discretion, notify You by the email informed upon registration about Your outcome in the Crown Challenge.
   • If You have a paid subscription with GameHouse and You claim Your Reward during the Claiming Period, the claimed Reward will be awarded to Your next subscription period at the end of which Your regular subscription will resume; if You do not have a paid subscription and You claim Your Reward during the Claiming Period, the Reward will be awarded immediately after it is claimed by You.
6. Explicit consent for public announcements. Participation in the Crown Challenge and/or acceptance of the Reward constitutes Your consent to, and grant of, a perpetual, worldwide, royalty-free to use Your name, address (city, state, country), likeness, or alike for advertising and marketing promotion without notice or additional compensation, except where prohibited by law. To opt-out from any public announcements, please contact customer support through Your account or write us an email at [e-mail].
7. Rewards are awarded “as is, where is,” without warranty of any kind, express or implied, including without limitation any warranty of merchantability or suitability for a particular purpose.
8. Limitation of Liability. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAWS, YOU ACKNOWLEDGE AND AGREE THAT IN NO EVENT WILL GAMEHOUSE BE LIABLE OR OTHERWISE RESPONSIBLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL AND/OR PUNITIVE DAMAGES, FOR ANY REASON(S) OR FOR ANY CAUSE(S), REGARDLESS OF WHETHER GAMEHOUSE WAS/IS INFORMED OF THE POSSIBILITY THAT SUCH DAMAGES MAY EXIST.
9. You agree to hold harmless, indemnify and defend GameHouse, its officers, directors, agents and employees, from and against any claims, liabilities, losses, damages, judgements, awards, fines, penalties, fees and/or expenses (including attorneys' fees and costs) arising out of or relating to, either directly or indirectly, by Your violation of any of the Terms.
10. Without any liability to You, GameHouse reserves the right to refuse, restrict, prohibit, suspend or reject Your access to, use of, and/or participation in the Crown Challenge, at any time, if You are in breach or violation of these Terms. Immediately upon termination by breach, You forfeit all rights, title and interests in and/or to any Reward. Any attempt by You to undermine the legitimate operation of the Crown Challenge by cheating, deception or other unfair playing practices or intending to annoy, abuse, threaten or harass any other participants may also result in Your disqualification in addition to any other available remedy, including, but not limited to, damages and attorney’s fees.
11. Notices and Support. Any questions regarding the Terms and all legal notices shall be sent to by email to [e-mail]. You can also contact customer support through Your account or via the online form.
12. Changes to the Terms. GameHouse reserves the right, in its sole discretion to cancel, modify or suspend the Crown Challenge in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the Crown Challenge is, in whole or in part, compromised. GameHouse furthermore reserves the right to substitute the Reward or amend the Terms at any time. Any such modifications will be published on www.GameHouse.com.
13. General Provisions. You acknowledge and agree to comply with all applicable laws, codes, regulations, rules and/or requirements regarding Your registration, access, use and/or participation in the Crown Challenge. These Terms and any rules, terms or policies referenced herein or incorporated herein are the complete agreement of the parties concerning the subject matter hereof and may not be amended or in any manner modified except at GameHouse sole discretion. If any provision of the Terms is found to be unenforceable, the remainder shall be enforced as fully as possible, and the unenforceable provision shall be deemed modified to the limited extent required to permit its enforcement in a manner most closely representing the intention of the parties as expressed herein. Failure to enforce any provision of the Terms will not constitute a waiver of any the terms and conditions. The English language version of the Terms controls and governs.
